We residents can take legal action against the night-time closure of the Görli - so let's do it! We need money for the lawsuit - so on January 10, together with the "Görli zaunfrei" alliance, we're holding a fundraising gala at the Lido.
Admission: 5.30 pm
Start: 18.00 hrs
As soon as the Berlin Senate publishes the order that the Görli is to be cordoned off at night by means of the fence system that has been built by then, we can take legal action against this order. The action will then have an immediate suspensive effect, i.e. the Görli will remain open until a final court decision is made on the matter. The action will probably go from one instance to the next until the highest administrative court decides. In the meantime, the insanely expensive and heavily guarded fence stands there in the landscape without any function.
The chances of winning the case are pretty good. This is because, in order to enforce the closure, it must not only be "appropriate" in terms of weighing up the restriction of fundamental rights, but must also be the most suitable measure to achieve the objectives specified by the Senate. The goal is always stated as being to reduce crime, but most crimes in the so-called "crime-ridden area" do not actually take place in Görli, nor at night. There is therefore no evidence to suggest that a night-time closure would lead to an expected reduction in crime. On the contrary, we fear that driving people out of the Görli every night will put even more strain on the conditions in the surrounding neighborhoods.
