This lecture demonstrates how, paradoxically, the decline of democracy is already embedded in constitutions and fundamental laws. A sub-constitutional branch of law emerges in which democracy, through its own means, inevitably drives itself beyond its own limits—a shadow of democracy that easily becomes “shadow democracy.” One example of this is the regulation—and lack thereof—of the energy sector. Here, the decline of democracy and capitalism can be experienced firsthand. I distinguish this from “fascism,” “tyranny,” and “dictatorship.” Instead of conjuring up disaster, we should imagine utopias.
