When people can no longer manage their own affairs, a number of questions arise:
- Who will manage their financial affairs?
- Who will arrange for their housing?
- Who will serve as the point of contact for doctors and consider appropriate treatments?
Without a power of attorney, children are not permitted to make decisions for their parents, and spouses do not automatically have the authority to make decisions on each other’s behalf. Many people are unaware of this and are often frustrated when the local court must be involved. The court then determines whether legal guardianship is necessary (Section 1814 of the German Civil Code [BGB]).
You should therefore take precautions by granting power of attorney to someone you trust. Even family members need a power of attorney to make legally binding decisions. The presentation will offer guidance on drafting a power of attorney and provide information on its use and safekeeping.
This event, featuring Ms. Winkelmann from the Guardianship Authority, is aimed at people who wish to learn about power of attorney and guardianship law so that they can work with their family members and friends to make the best possible decision for everyone involved.
